This Privacy Policy applies to Kindable, Inc., a Delaware corporation (“Kindable,” “we,” “us,” “our,” or the “Company”), and governs information collected through websites, hosted product platforms, digital properties, and online services owned, operated, or administered by the Company, including, but not limited to, www.kindable.com and all websites operating under the Kindable parent brand (collectively, the “Websites”). Services provided by or enabled through the Websites are referred to herein as the “Services.”
This Privacy Policy describes the types of information we collect about visitors to and users of our Websites and users of websites hosted by the Company on behalf of Kindable’s contracted customers (“Customers”). This Privacy Policy is designed to help you understand how we collect, use, and safeguard the information you provide to us and to assist you in making informed decisions when using our Services.
Kindable provides supportive, health-adjacent, non-clinical technology designed to assist with wellness, aging-in-place, caregiving coordination, and quality of life. The Services are not medical devices or medical services and are not intended to diagnose, treat, cure, or prevent disease or replace professional or emergency care.
Kindable provides technology and platform services to its Customers for the purpose of fulfilling obligations undertaken in customer agreements (each, a “Customer Agreement“). Kindable processes Customer data in accordance with Customer direction and has no direct relationship, control, or ownership of the data it processes under any Customer Agreement. Customers are responsible for complying with all applicable laws and regulations, including, without limitation, laws regarding the provision of notice, disclosure, and the legal basis for disclosure prior to transfer of data to Kindable for processing purposes. If you are an end-user of a Kindable Customer, you should review any additional privacy policy and terms of use applicable to that Customer’s website or service. Kindable is not responsible for the content or privacy practices of non-Kindable websites to which any Kindable Website may link.
In addition to the Websites, Kindable operates cloud-based software platforms and digital services for its Customers. The use of information collected through these platforms is strictly limited to the purpose of meeting our contractual obligations to our Customers and providing the services requested, as defined within the applicable Customer Agreement.
If you use a Kindable product or service through an account provided by an organization with which you are affiliated (such as an employer, association, or other entity), that organization may:
If your organization provides you with access to Kindable products or services, your use is subject to your organization’s applicable policies. You should direct your privacy inquiries, including any requests to exercise your data protection rights, to your organization’s administrator. Kindable is not responsible for the privacy or security practices of its Customers, which may differ from those set forth in this Privacy Policy.
When you use a Kindable product provided by your organization, Kindable’s processing of your personal data in connection with that product is governed by a contract between Kindable and your organization. If you have questions about how Kindable processes your personal data in connection with a product provided by your organization, please contact your organization directly.
Kindable’s Websites and Services are not designed for use by children under the age of sixteen (16). Our Websites are not directed at children under the age of sixteen (16), nor do we knowingly collect personal information from children under the age of sixteen (16). If we learn or have reason to suspect that we have collected personal information from a child under the age of sixteen (16) without appropriate parental or guardian consent, we will promptly delete such information. With respect to our platforms, none of the Kindable products are intended to collect information directly from children; however, our Customers may collect information about children in connection with their own services. Through our agreements with our Customers, we require that Customers comply with all applicable laws and regulations regarding the processing of data about children, including the Children’s Online Privacy Protection Act (“COPPA”).
If you are a child under the age of sixteen (16), you may access the Service only to the extent that consent is given or authorized by the holder of parental responsibility over you. Please speak with your parent or guardian about this Privacy Policy so that you may better understand how we use your personal data. We make reasonable efforts to verify that consent is given or authorized by the holder of parental responsibility over you. If we learn or have reason to suspect that we have collected personal data from a child without verifiable parental or guardian consent, we will promptly delete such information.
A parent or guardian who has already given Kindable or our Customer permission to collect, use, and share their child’s personal information may, at any time: (1) review, correct, or request deletion of the child’s personal information; and/or (2) discontinue further collection, use, or sharing of the child’s personal information. To exercise any of the foregoing rights, please contact us in accordance with the “How to Contact Us“ section below.
Depending upon the Kindable Website, platform, or Service you are accessing, or the nature of your contact with us, we may collect the following categories of information:
Kindable provides products, including platforms, websites, and applications, to our Customers. In the context of our platform services, Kindable Customers are the owners of the personal information collected from their end-users. Our Customers determine what data to collect, which typically includes information about their end-users, customers, prospects, employees, consultants, independent contractors, suppliers, and other individuals or third parties. We collect and process such information solely under the direction of our Customers and have no direct relationship with the individuals whose personal information we process on behalf of our Customers.
Kindable also accesses and collects information that you voluntarily provide to us via email, web form, or other direct contact. We will use your information to respond to you regarding the reason for your inquiry. We will not sell or rent this information to any third party. We may disclose such information to our corporate affiliates and to third parties for the purpose of providing products and services to you, or in connection with products or services you have purchased, downloaded, or otherwise accessed from Kindable. Unless you request otherwise, we may contact you via email or text message in the future to inform you of our services, new product offerings, changes to this Privacy Policy, or to provide you with informational or educational communications.
Kindable may access Customer data for the purposes of providing and enhancing services, preventing or addressing service or technical problems, responding to support issues, fulfilling Customer instructions, or as may be required by applicable law, in each case in accordance with the relevant Customer Agreement.
Kindable collects certain additional information in connection with your use of our Services, web-based products, and software with online features. For instance:
Product Updates. Certain products provide you with the ability to download and register product and content updates as they become available. During the download and registration process, we may collect business-related information, including customer identification numbers and product version and type. This information is collected so that we may authorize your access, provide you with the appropriate update, and maintain our records regarding the products and updates you have downloaded or installed.
Account Set-Up and Access. Upon subscribing to our Services, Kindable may collect business-related information, including product identification numbers, customer identification numbers, and customer profile information. This enables us to authorize your access to and use of the Services and to provide you with relevant account information. Certain products allow you to access your account to view information such as support plan status, service subscriptions, registrations, and order history.
Online Product and Account Applications. Certain products and services are subject to an application and enrollment process, which may be completed online or in paper form. Information requested may include identification, contact, and billing information. This information is used to process your enrollment request and, if approved, to set up and administer your account.
Web-Based Services. Certain web-based Services collect additional information automatically, including IP address, browser type, connection speed, domain, referring URL, and other environment-related information. This information enables us to provide a secure environment for the use of our Services, to pre-populate forms, and to calculate aggregate statistical information about users of our Services.
Kindable offers customer support services. If you access our support services, you may be asked to provide information such as your customer identification number, product name, product version, and other details to help us identify and resolve technical issues. Certain products may allow you to submit support-related requests directly from within the product interface, in which case information about your network, operating system, and similar technical details may be automatically pre-populated for submission to our support team.
Certain Kindable Services may allow you to connect third-party tools such as calendars or applications. These integrations are optional and initiated by you. Third-party services operate under their own privacy policies. When you connect a third-party service, you authorize Kindable to import or export information to support the integration. Data syncing may continue until you disconnect the integration through your account settings. You remain responsible for reviewing the privacy practices of any integrated third-party services.
Kindable may use your business or account information to inform you of special offers or products from third parties that we have evaluated and believe may be of interest to you. Any such communications will be made in accordance with applicable law and this Privacy Policy.
Information that you submit, post, or otherwise disclose in a public forum (such as a blog comment section, community discussion board, or product forum hosted on or through our Websites) is not subject to this Privacy Policy, will be visible to third parties not affiliated with Kindable, and may be used by such third parties or by Kindable to contact you for any purpose. You should exercise caution when choosing to share personal information in any public forum.
Certain Services may allow you to grant access to your account or information to other individuals, such as family members, caregivers, or other authorized users. By granting such access, you acknowledge that authorized users may view or manage your information as permitted. You are responsible for managing and revoking permissions. You represent that you have the authority to grant such access and that all persons to whom you grant access are authorized to receive the information they access through the Services.
Certain Kindable mobile applications and web-based services may provide Customers with the ability to publish information about their users or members, such as name, contact information, photographs, and other personal details. Kindable Customers use this functionality to connect their users with other users and to provide networking and community opportunities within their respective platforms.
To access certain content or features available through the Websites (including, without limitation, product demonstrations, marketing materials, and similar resources), a user may be required to register with Kindable. During registration, a user may be required to provide certain information (such as name, email address, and job title). This information is used to contact you regarding the products and services in which you have expressed interest.
To purchase products or services from us, you must provide contact information (such as name and billing address) and financial information (such as credit card number and expiration date). All payment data is processed and stored by our third-party payment processors. You should review the applicable payment processor’s privacy policy and contact the payment processor directly with any questions regarding the handling of your payment data. Kindable uses this information for billing purposes and to fulfill your orders. If we experience difficulty processing an order, we may use this information to contact you.
From time to time, our Websites may request information via surveys or contests. Participation in these surveys or contests is completely voluntary, and you may choose whether or not to participate and disclose the requested information. Information requested may include contact information (such as name and address) and demographic information (such as zip code). Contact information will be used to notify winners and award prizes, where applicable. Survey information will be used for purposes of monitoring or improving the use of, and satisfaction with, our Websites and Services.
Each promotional email and/or text message we send will contain clear instructions on how to unsubscribe should you decide not to receive future promotional communications. If you choose to opt-out of receiving promotional email and/or text communications from Kindable, we may still communicate with you via email, mail, or telephone for non-promotional purposes (such as transactional notices, service updates, or legally required communications). Please allow up to ten (10) business days to be removed from our promotional communication list following your opt-out request.
We send notification emails and communications about the Websites and Services from time to time as necessary for the operation of the Services. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you may have the option to deactivate your account.
If you access or use any third-party provider’s services through a link on our Websites, any information you provide in connection with such third-party service is submitted directly to that third party and is not subject to this Privacy Policy. You should consult the applicable privacy policy of any such third-party partner or linked site regarding its treatment of information you disclose through that service.
Business information collected by Kindable does not include data entered by you in the course of operating our products (“Product Data“) or data provided by you while using our Services (“Services Data“). Kindable will not access your Product Data or Services Data except in the following limited circumstances:
Kindable will not provide your Product Data or Services Data to any third party, or permit any third party to access your Product Data or Services Data, except with your permission or to comply with valid legal requirements, such as applicable laws, regulations, search warrants, subpoenas, or court orders. In the event you discontinue use of an applicable Service, your Services Data will be handled in accordance with the terms set forth in your Customer Agreement, subject to applicable backup and disaster recovery practices and procedures.
Kindable may place “cookies” on your browser when you visit our Websites. Cookies are small data files stored by your browser on your computer’s hard drive. Cookies may enhance the convenience and functionality of the Websites. You may choose to decline cookies if your browser so permits; however, doing so may affect your ability to access or use certain features or functionality of the Websites.
Kindable may also utilize web beacons on our Websites. A “web beacon,“ also known as an internet tag, pixel tag, or clear GIF, links web pages to web servers and their cookies, and may be used to transmit information collected through such cookies to a web server. The information collected through these automated means may include your IP address, type of browser and operating system, date and time of access, pages visited, and, if you navigated to our Websites from another website, the address of that referring website. This data does not generally include directly identifying personal information, though we may, in certain circumstances, link an IP address to information that is personally identifiable.
Kindable may allow certain third-party analytics service providers to include cookies and web beacons within the pages of our Websites on our behalf and to retain and use information received from such cookies and web beacons. Third-party service providers that collect data on our behalf may offer information about their data collection practices and, in some cases, an opt-out mechanism on their respective websites. We encourage you to review the privacy policies of any such third-party analytics providers.
Various web browsers offer a “Do Not Track“ or “DNT” option that sends a signal to websites visited by the user about the user’s DNT browser preference. Kindable does not currently commit to responding to browsers’ DNT signals with respect to its Websites, in part because no common industry standard for DNT has been adopted by industry groups, technology companies, or regulators. We take privacy and meaningful choice seriously and will continue to monitor developments around DNT browser technology and any applicable emerging standard.
Certain data may be retained for a limited period in backup systems or as required for legal, compliance, security, or dispute resolution purposes.
We retain your information for a period of time consistent with the original purpose of collection. We may retain your information during the period in which you maintain an account or active relationship with us and for a reasonable period of time thereafter. We may also retain your information for the period of time necessary to pursue our legitimate business interests, conduct audits, comply with our legal obligations, resolve disputes, and enforce our agreements. When we no longer have a lawful basis for retaining your information, we will take reasonable steps to delete or de-identify it.
Kindable takes reasonable and appropriate precautions to protect your information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. When you submit sensitive information via our Websites, your information is protected using industry-standard security measures both online and offline. These measures vary based on the sensitivity of the information we collect, process, and store, and are assessed in light of the current state of technology. These safeguards include role-based access controls, audit logging, data minimization practices, and vendor security review processes. Notwithstanding the foregoing, no website, internet transmission, or data storage system is completely secure, and while we strive to protect your data, we cannot guarantee that unauthorized access, hacking, data loss, or a data breach will never occur. In the event of a data breach affecting your personal information, we will provide notification in accordance with applicable law.
Unless you give us your express permission, we do not share personal data we collect from you with third parties, except as described below:

Pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, “CCPA/CPRA”), California residents have the following additional data privacy rights:
To exercise any of the foregoing rights, please contact us in accordance with the “How to Contact Us“ section below. If you prefer, you may designate an authorized agent to submit a CCPA/CPRA privacy request on your behalf. An authorized agent must be registered with the California Secretary of State to conduct business in California.
If you (or your authorized agent) submit a request related to your personal information under the CCPA/CPRA, Kindable will verify your identity (and the identity of any authorized agent, where applicable) to the degree of certainty required or permitted under applicable law before addressing your request. Kindable may require you to verify your request via email or other reasonable means and to match at least two pieces of personal information previously collected from you. We may require written documentation evidencing an authorized agent's authority to act on your behalf, unless you have granted that agent a power of attorney pursuant to California Probate Code §§ 4121–4130. California residents have the right to opt-out of the sale or sharing of their personal information. Kindable does not sell your personal information. To the extent Kindable engages in sharing of personal information for cross-context behavioral advertising purposes, California residents may opt out by contacting us as provided in the “How to Contact Us“ section below.
Residents of certain U.S. states, including Virginia, Colorado, Connecticut, Utah, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, and Oregon, may have additional rights with respect to their personal data under applicable state privacy laws. These rights may include the right to access, correct, delete, and obtain a portable copy of personal data Kindable holds about you, as well as the right to opt-out of certain processing activities such as targeted advertising or the sale of personal data.
To the extent such rights apply to you under the laws of your state of residence, you may submit a request by contacting us in accordance with the “How to Contact Us“ section below. Kindable will respond to your request within the timeframe required by applicable law. Kindable will not discriminate against you for exercising any rights you may have under applicable state privacy law.
To the extent Kindable acts as a service provider to its Customers, the data in our systems is owned by our Customers, and any end-user data subject request should be submitted directly to the applicable Customer. Customers’ users may be able to access, correct, and update certain information within applicable platforms. For additional requests, please contact the applicable Kindable Customer directly.

Kindable Customers may exercise their rights by contacting us at support@kindable.com. All requests will be addressed within the timeframe required by applicable law. If the collection of your personal data was based on your consent, you have the right to revoke that consent at any time; however, revocation of consent may affect your ability to access or use certain Services. If you are an end-user of a Kindable Customer’s platform and not a direct Kindable Customer, please contact the applicable Customer directly to exercise your rights.
Certain products and services offered through the Kindable platform are designed to support the health, well-being, and social connection of users and their families. In connection with your use of these Services, you may voluntarily share information that relates to your physical or emotional health, including but not limited to:
This information is submitted voluntarily by you and is not required to use the Services. You are under no obligation to share health or wellness information, and you may use the Services without disclosing any such details. In jurisdictions where this information is classified as ‘sensitive personal information’ or ‘sensitive data,' you may have additional rights to limit or object to our processing of this information as described in the ‘California Privacy Rights’ and ‘Additional U.S. State Privacy Rights’ sections below.
Any health or wellness information you voluntarily provide through the Services is used solely for the following purposes:
Kindable does not use your health or wellness information to train or improve artificial intelligence models without your explicit consent. To the extent third-party artificial intelligence service providers are used, Kindable will disclose this in the Services and these third parties are bound by data protection obligations in accordance with applicable law.
Kindable does not sell, rent, or share your sensitive health and wellness data with third parties for their own marketing, advertising, or commercial purposes.
Kindable treats health and wellness information with heightened care and applies appropriate technical and organizational safeguards to protect it from unauthorized access, use, or disclosure. These measures include encryption of sensitive data in transit and at rest, role-based access controls limiting which personnel and systems may access sensitive data, audit logging, vendor security review processes, and data minimization practices.
Kindable Services may include automated features that use artificial intelligence and automated calling technology to interact with users. These automated interactions may include voice calls that ask questions and collect information based on your responses. When you use these features, please note:

Kindable is not a licensed healthcare provider, health plan, or healthcare clearinghouse, and the Services are not a substitute for professional medical advice, diagnosis, or treatment. The Services are designed for supportive, non-clinical tools intended to assist with aging-in-place, caregiving coordination, wellness support, safety, and quality of life. If you experience a medical emergency or have an urgent health concern, please contact a licensed healthcare professional or call emergency services immediately.
Kindable’s consumer Services are generally not provided as a HIPAA-covered entity or business associate as defined under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), and information you provide through those Services is generally not protected by HIPAA unless expressly stated otherwise in a separate agreement. However, Kindable is committed to handling all sensitive information responsibly. Health-related data you provide is protected under this Privacy Policy, applicable federal law including the FTC Health Breach Notification Rule, and applicable state privacy laws.
In the event of a breach of unsecured personal health records or related electronic health information collected through the Services, Kindable will provide breach notification to affected users and relevant authorities (including the Federal Trade Commission) as required by applicable federal and state law, including the FTC Health Breach Notification Rule, 16 C.F.R. Part 318, as amended.
